- Uniform Principles have been laid down for Member States to use in the evaluation and authorisation of chemical plant protection products only.
- Member States shall evaluate the physical and chemical properties of the plant protection product and the retention of these characteristics after storage and take into consideration:
- Furthermore the chemical has not been identified or notified under the Community review programme for evaluation of existing substances under Directive 98/8/EC. It is thus not allowed for use as a plant protection product or biocide.
- The chemical was not included in the Community programme for evaluation of existing substances under Council Directive 91/414/EEC of 15 July 1991 concerning the placing of plant protection products on the market (OJ L 230, 19.8.1991, p. 1).
- For example, a chemical manufacturer may have to install a certain new chemical handling process in order to comply with environmental requirements on the production and storage of dangerous chemicals; related plant enhancements are recognised as an asset to the extent they are recoverable because, without them, the enterprise is unable to manufacture and sell chemicals.
- The French and Irish plants benefit from a similar exemption, the German plant uses natural gas that is also exempted from excise duties and the plants in Spain and Greece do not compete with the Sardinian plant to a significant extent, as the major part of their production is used in an adjacent aluminium smelter and the remaining part consists principally of chemical grade alumina which is a separate market.
