9. Paragraph 1 shall not apply in the case of re-export to the importing country cited in the application and identified in the packaging and documentation associated with the product, or placing under a transit or customs warehouse procedure or in a free zone or free warehouse for the purpose of re-export to that importing country.
10. The provisions of the Agreement may be applied to goods exported from either Switzerland to one of the new Member States or from one of the new Member States to Switzerland, which comply with the provisions of Protocol No 3 and that on the date of accession are either in transit or in temporary storage, in a customs warehouse or in a free zone in Switzerland or in that new Member State.
11. This Directive should not apply to defence-related products which only pass through the territory of the Community, namely to those products which are not assigned a customs-approved treatment or use other than the external transit procedure or which are merely placed in a free zone or free warehouse and where no record of them has to be kept in an approved stock record.
12. The provisions of the Agreement shall be applied to goods exported from either Mexico to one of the new Member States or from one of the new Member States to Mexico, which comply with the provisions of Annex III to Joint Council Decision No 2/2000 and which on the date of the accession of the new Member States to the European Union were either in transit or en route or were in Mexico or in a new Member State in temporary storage, in a customs warehouse or in a free zone.
