This raises a potential risk of cross-compensation, i.e. that any undertaking prices would be formally respected but that prices for products other than the one concerned would be lowered when sold together with the product concerned.
- A breach of the cross-compensation clauses of the undertaking occurred since the company sold both, the product covered by the undertaking and other products to the same client in the same calendar year but continued to issue undertaking invoices for the product covered.
- With regard to the examination on a product type basis, and as indicated in recital (27), the Commission considered domestically sold and exported product types, which had similar origin, denier, composition, cross-section, lustre, colour, silicon treatment, quality and use, as being directly comparable.
- The Community industry further argued that, because the exporting producers sell the product covered by the undertaking to multinational companies, there is a high risk of price cross-compensation i.e. the product covered by the undertaking may be sold to the same customer at artificially low prices outside the EC in order to compensate the minimum prices in the EC.

The product is also often referred to as ‘hollow section’.
- The product allegedly being dumped is welded tubes, pipes and hollow profiles of square or rectangular cross-section, of iron other than cast iron or steel other than stainless, but excluding line pipe of a kind used for oil or gas pipelines and casing and tubing of a kind used in drilling for oil or gas, originating in Belarus, Turkey and Ukraine (‘the product concerned’), normally declared within CN codes 73066192 and 73066199.
- The product concerned is certain wire of non-alloy steel (not plated or not coated or plated or coated with zinc) and stranded wire of non-alloy steel (whether or not plated or coated), containing by weight 0,6 % or more of carbon, with a maximum cross-sectional dimension exceeding 3 mm, originating in the People’s Republic of China (the product concerned), normally declared within CN codes ex72171090, ex72172090, ex73121061, ex73121065 and ex73121069.
- The product concerned is certain seamless pipes and tubes, of iron or steel, of circular cross section, of an external diameter not exceeding 406,4 mm with a Carbon Equivalent Value (CEV) not exceeding 0,86 according to the International Institute of Welding (IIW) formula and chemical analysis [4], originating in the PRC (the product concerned) and currently falling within CN codes ex73041910, ex73041930, ex73042300, ex73042910, ex73042930, ex73043120, ex73043180, ex73043910, ex73043952, ex73043958, ex73043992, ex73043993, ex73045181, ex73045189, ex73045910, ex73045992 and ex73045993 [5].
